Full Terms & Conditions, Privacy and Cookies Policy of Ynotart

Terminology

In these Terms and Conditions:

The term "Ynotart", "us", "we", "I" or the "Seller" refers to the owner of the website, artist Anthony Robshaw. The term "you" refers to the user or viewer of the website. The term "buyer", "customer", or "purchaser" refers to the person or persons from whom orders are placed on this website.

"Items", "Goods" or "Artwork" means the product(s) that the Buyer agrees to buy from the Seller by way of a Contract. Website means http://www.ynotart.co.uk.

Ordering

Any order received for Artwork will be seen to be an offer by the Buyer to purchase the Artwork in accordance with these Terms and Conditions and is subject to acceptance by the Seller who may choose not to accept the order for any reason.

Cancellation

Buyers have the right, in addition to any other statutory rights, to cancel the contract and receive a full refund by informing the 'Seller' in writing or by email or by telephone within 14 days of receiving your order. You then have a further 14 days to return the goods in their original condition at your own expense to the seller for a refund. The seller will reimburse the order within 14 days of either receiving the goods, or the buyer providing evidence of having returned them (e.g. providing proof of posting) whichever is the sooner.

If the Goods are damaged or defective, the Goods will be returned to us. The Customer will be entitled to receive a full refund (including delivery costs) plus the postal cost of returning the Goods.

If returned Goods are found to be damaged which is the fault of the Buyer, the Buyer will be liable for the cost of repairing such damage.

Pricing and Payment

The price of Artwork is clearly stated on the gallery page. The total purchase price, including any delivery charges will be displayed to the Buyer before confirming the order. After the order is received the Seller will confirm the details, description and price for the Goods ordered. Cleared payment of the total order price including delivery charges must be made in full before despatch of the Goods in accordance with the Sellers terms.

All prices on the gallery pages are in Pounds Sterling, and all payments must also be made in Pounds Sterling.

Rights of Seller

The Seller reserves the right to amend the price and specification of any Artwork listed on the gallery page at any time.

The Seller reserves the right to withdraw any Artwork from the gallery page at any time.

Quality of Goods

In accordance with the Sale of Goods Act, the Seller must supply Goods which are of a satisfactory quality. This means Goods must be of a standard that a reasonable person would regard as satisfactory, the description of the goods, fitness for the purpose for which goods of the kind are supplied, and the appearance and finish.

Delivery

The seller agrees to the following:

Despatch of items listed as "for sale" within a maxiumum of 7 working days from receipt of the order (usually will be much less e.g. 1 - 2 days.)

The Goods must be safely packed to prevent damage in transit and a reliable insured courier or delivery method must be used to help prevent an occurrence of loss or damage.

I endeavor to deliver in the UK within reasonable stated times subject to the limitations set by my delivery agents. Since deliveries are made by these third parties, times are subject to change without notice. If you seriously need any paintings delivering by a certain date subsequent to an order, please contact me for help before ordering.

When you purchase Goods online for delivery you will:

Accept delivery of the Goods and sign for it if required.

Be charged for delivery unless advised that the price quoted includes delivery charges.

Buying in Person

I appreciate that some customers prefer to see paintings before purchase. This is understandable in view of the limitations of web viewing and the large investment being made. Much of my available artwork is available to view and buy locally in Darwen at either Deli Carlo or the Sweet Vintage Tea Room. Alternatively contact me to arrange a viewing or personal sale.

Framing

Frames shown in the image gallery are FOR IMAGE DISPLAY PURPOSES ONLY. All online purchases are for paintings on canvas or paper as appropriate and stated in the item details, but WITHOUT FRAME / GLASS. Of course, I should be happy to advise or arrange framing on request, but due to the difficulties / complications in sending paintings framed, as well as the fact that frames are a personal choice to suit buyer circumstances and preferences, my standard practice is to supply all items unframed for online purchases. Watercolours and some other paintings on paper, however, where appropriate and always as stated in the item details, will be supplied with the (card) mount. Personal callers to either of the [viewing locations] may take the opportunity to purchase the artwork pre-framed.

International Orders

Standard delivery charges quoted on the website are for UK delivery only. International orders may be taken, but international buyers must contact us first to obtain a delivery cost to your chosen destination.

If you are ordering from outside of the UK you may become liable for import duties and taxes, of which you are responsible for payment.

Payments by PayPal

Online payments can be made by credit or debit card using the secure online payments system PayPal - www.paypal.co.uk

You will receive a notification to confirm receipt of your order by the Seller and you can also view the order and your payment in your PayPal account. Neither order nor customer information is stored on the Ynotart web server.

Applicable Law

These Terms and Conditions and any orders for artwork placed shall be made in, governed by, and construed in accordance with the Law of England.

Privacy Policy

Your privacy is important to me. To better protect your privacy I provide this notice explaining my online information practices and the choices you can make about the way your information is collected and used.

The Information Collected

This notice applies to all information collected or submitted on or via this website. On some pages, you can order artwork or contact the Seller. The types of personal information collected at these pages are:

  • Name
  • Email address
  • Phone Number

Such information is never stored by us, but ordering information passed will be retrieved from the secure, permanent Paypal records as appropriate and used for customer order processing and fulfillment only. If your email is passed to our website by way of the contact page, this also is not stored permanently in a database or on our server, but merely retained within emails during any electronic communication between the Seller and (actual or interested) Buyer i.e. I use return email addresses to answer the email I receive. Such addresses are not permanently stored, nor are they used for any other purpose or shared with outside parties.

The Information I do not Collect

Credit/Debit Card Information, which information is handled entirely by PayPal (secure online payments system.) I do not have access to your payment details. Paypal simply notifies me of the buyer's delivery address details once the payment has been made.

The Way I Use Information

I use return email addresses to answer any email received. Such addresses are not used for any other purpose and are not shared with outside parties.

Finally, be assured that I never use or share the personally identifiable information passed to this website, however limited, in ways unrelated to the ones described above.

Cookies Policy

A cookie is a text-only string of information that a website transfers to the cookie folder of the browser on your computer's hard disk so that the website can remember who you are. In general cookies allow web applications to respond to you as an individual, by tailoring its operations to your needs, likes and dislikes, usually by gathering and remembering information about your preferences.

On the Ynotart website, no such cookies are programatically or consciously set by the website creator to store or retrieve information about you. However, the website application server itself, as part of its internal standard system of operation will usually automatically (attempt to) set a cookie to help identify a unique user's browser via a token or number. This is standard for all web application servers. Such simple cookie information is used entirely within the application server itself, is not seen by Ynotart - although it could be accessed by programming - or the website administrator and in any event would provide no useful or sensible information to Ynotart. However, if you do not agree to the application server using cookies in this limited way, please change your cookie settings in your browser (see aboutcookies.org for more info.) This may or may not impair the way the application operates.

I reserve the right to change the Terms & Conditions, with the new version taking effect from the time of being published on the Ynotart website.
